The War Powers Act and the War Powers Clause are two distinct legal provisions in the United States Constitution that address the president's authority to commit U.S. military forces to hostilities or potential hostilities. The War Powers Clause, found in Article I, Section 8 of the Constitution, grants Congress the power to declare war and to raise and support armies. This clause has been interpreted to mean that only Congress can authorize the use of military force. In contrast, the War Powers Act, passed in 1973, is a federal law that limits the president's ability to commit U.S. military forces to hostilities without congressional approval. The act requires the president to notify Congress within 48 hours of committing U.S. forces to military action and prohibits those forces from remaining for more than 60 days without congressional authorization. The War Powers Act was enacted to ensure that Congress plays a role in decisions to commit U.S. military forces to hostilities, and to prevent the president from unilaterally engaging in military actions without congressional oversight.
